In this case, the petitioner is apprehending his arrest in connection with Samastipur Muffasil P.S. Case No. 645 of 2017 registered for offences under sections 380, 457 of the Indian Penal Code.
As per allegation, a theft was taken place in the house of the Informant who has shown suspicion of theft on Nirmala Devi and Ashish Kumar but, the theft materials have been recovered from the house of the petitioner. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Patna High Court Cr.Misc. No.26942 of 2018(2) dt.07-05-2018 2/2 Accordingly, the prayer for anticipatory bail of the petitioner, above named is rejected.
If the petitioner surrenders before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law preferably on the same day of appearance of the petitioner.
