This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner against the order dated 04.04.2018 passed by the learned Additional Session Judge, F.T.C.-II, Katihar in Session Trial No.277 of 2011 arising out of Barsoi P.S. Case No.136 of 2010 whereby the court below has rejected the petition dated 15.03.2018 filed by the petitioner under Section 216 of the Cr.P.C.

Having perused the petition filed by the petitioner before the court below, as contained in Annexure-3 to the present application, I find that the same is quite vague. There is neither any

Patna High Court Cr.Misc. No.31414 of 2018 dt.31-08-2018 clarity in the pleading nor one can discern as to what modification, alteration in charge or addition in charge the petitioner wanted. Apparently, it was a frivolous petition in order to delay the disposal of the case. The court below has rightly rejected the same. 4.

Accordingly, the application is dismissed.
