This application is filed for grant of regular bail to the appellant in S. Tr. No. 200 of 2014 arising out of Khagaria (Muffasil) P.S. Case No. 663 of 2013 registered for offences under Sections 147, 148, 149, 323, 307, 504 and 506 of the Indian Penal Code, 27 of the Arms Act and 3(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. By order, dated 23.03.3018, the prayer for regular bail of the appellant has been rejected by Additional Sessions Judge, I, Khagaria.
Counsel for the appellant submits that this is a case of misuse of privilege of bail. In the impugned order it is mentioned that bail bond of the appellant was cancelled on
Patna High Court CR. APP (SJ) No.1712 of 2018(3) dt.23-05-2018 2/2 31.08.2017. The appellant has been remanded in this case on 19.03.2018.
This Court feels that the appellant has sufficiently been punished.
Considering the entire facts and circumstances, aforesaid, let the appellant, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with S. Tr. No. 200 of 2014 arising out of Khagaria (Muffasil) P.S. Case No. 663 of 2013 to the satisfaction of the Additional Sessions Judge, I, Khagaria.
It is, further, made clear that the appellant shall remain physically present in Court on each and every date during the trial and absence on two consecutive dates without valid reason will amount to cancellation of the bail bond. (Sanjay Priya, J) Shamshad/- U T
