The petitioner apprehends his arrest in Kotwali (Adampur) P.S. Case No.163/2017 registered under Sections 406, 420, 467, 468 and 471/34 of the Indian Penal Code. The informant alleged that he purchased a piece of land from Smt. Rani Rai. The petitioner is one of the witnesses but later on she came to know that Rani Rai fraudulently executed sale deed without having title over the land.
Learned counsel for the petitioner submits that the sale deed was executed in the year 2011. The petitioner is a witness to the sale deed. The petitioner neither received consideration
Patna High Court Cr.Misc. No.29490 of 2018 (2) dt.18-05-2018 2/2 amount nor in any way instrumental in executing the same. Taking into consideration the aforesaid fact that the petitioner was a simple witness on the sale deed executed by Rani Rai, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur, in connection with Kotwali (Adampur) P.S. Case No.163 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
