2. In this case, the petitioner is seeking regular bail in connection with Ramkrishna Nagar P.S. Case No. 597 of 2024, registered for the offences punishable under Sections 103(1), 61(2), 351(2), 3(5) of the BNS and 27 of Arms Act.
3. As per FIR, the husband (deceased) of the informant was a witness in Ramkrishna Nagar P.S. Case No. 225 of 2024 and co-accused Sonu Kumar was accused in that case. Said Sonu, his wife, his brother Mithu along with Mithu's wife, his sister Nitu Devi, and his mother came to the shop of the deceased and they told him to withdraw that case, otherwise he would face dire consequences. Patna High Court CR. MISC. No.539 of 2026(2) dt.09-01-2026 2/3 to his house and narrated the entire occurrence to his family members. It is alleged that on the same day, at about 9:00 PM, the accused persons named in the FIR along with this petitioner came to the house of the informant and they fired at the deceased, who died.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. There is allegation against six persons of opening fire at the deceased, but only one injury was there on the person of the deceased. It was Sonu, who was accused in the earlier case. Sonu and his family members threatened the deceased to withdraw that case. Said Sonu Kumar has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 53908 of 2025. Brother of Sonu Kumar namely Mithu Kumar has also been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 34973 of 2025. The petitioner is under custody since 21.07.2025.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties
