Petitioner apprehends his arrest in connection with Civil Lines P.S.Case No. 103 of 2017 registered for the offences punishable under Sections 323 and 307 of the Indian Penal Code. Allegation against the petitioner is that he stabbed his brother and also assaulted his wife by iron rod. Submission of learned counsel for the petitioner is that the informant is his own brother and due to family dispute the occurrence took place.
Heard learned APP also. From perusal of the injury report it appears that injury is grievous in nature. Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory
Patna High Court Cr.Misc. No.35094 of 2018 (6) dt.07-09-2018 2/2 bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
