2. Petitioner seeks regular bail in connection with Spl. POCSO Case No. 66 of 2022 arising out of Amarpur P. S. Case No. 481 of 2022 in a case registered for the offence punishable under Section 366(A)/34 of the Indian Penal Code . 3 . As per the prosecution case, on 14.08.2022 at 08:00 P.M., the petitioner along with other co-accused persons took away the daughter of the informant and when the informant went at the house of the accused persons, he was abused, assaulted and threatened with dire consequences.

4. Learned counsel for the petitioner submits he was

He is living separately and has got no concern with co-accused Rahul Kumar. During investigation, the victim has stated that she was in love affair with co-accused Rahul Kumar and he called her on telephone on 14.08.2022. They went away and got married in a temple . The victim did not whisper a single word against the petitioner in her 161 Cr.P.C. statement. Both of them have solemnized marriage and are living together as husband and wife and now, they have also been blessed with a female child. The co-accused Rahul Kumar is already in custody. The petitioner is in custody since 09.10.2024 and claims clean antecedent. Chargesheet has already been submitted.

5 . Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed.

7. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-6-cum-Spl. Judge, POCSO, Banka in connection with Spl. POCSO Case No. 66 of 2022 arising out of
