Heard the parties.

The petitioner is languishing in custody for the offence punishable under Sections 326 and 307 of the Indian Penal Code. Later on Section 302 IPC was also added. Petitioner is in custody since 19.05.2018.

Allegation is that petitioner had given sharp cut wound to the father of the informant, as a result whereof he died during the course of treatment. Earlier prayer for bail was refused on 26.04.2019 in Cr. Misc. No. 8754 of 2019 with direction to the learned trial Judge to expedite the trial and liberty to the petitioner to renew the prayer, if trial is not concluded within six months from the date of said order.

Patna High Court CR. MISC. No.1141 of 2020(5) dt.10-06-2020 2/2 Submission is that the trial is still pending and there is no chance of conclusion of trial in near future due to COVID-19 effect.

Considering the aforesaid submission and the period already undergone by the petitioner, let the petitioner, above named, be released on bail, on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Session Trial No. 495 of 2018 arising out of Mahnar P.S. Case No. 89 of 2018 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
