The petitioner seeks bail in Baisi Police Station (for brevity, PS) Case No 48 of 2019 (GR No 679 of 2019) instituted for the offence punishable under Section (s) 379, 356, 395, 412 of Indian Penal Code.

Informant has alleged that after operating his Bank customer service centre, while he was returning, some persons have snatched Rs 3 lacs, Lap Top and Finger Print Scanner. Two persons have, thereafter, been apprehended, namely, Bikash Rai and Bikash Biswas. They have taken the name of the petitioner and, accordingly, he has been implicated in this case. It is further submitted that after petitioner's arrest, his confessional statement has also been made the basis of his implication. The petitioner has not been put on Test Identification Parade till date and he is in custody since 15.10.2019. After his arrest in the instant case, the petitioner has been remanded in one another case, namely, Sadar PS Case No 115 of 2019 and apart from the said case, there is one more case pending against him, i e, Kasba PS Case No 101 of 2019.

Learned APP for the State opposed the prayer for bail. Considering the aforesaid, let the petitioner, above named, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Baisi PS Case No 48 of 2019 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
