====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 11-09-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Barhara P.S. Case No. 343 of 2017 registered for the offences punishable under Sections 307 and 34 of the Indian Penal Code and under Section 27 of Arms Act. Informant has alleged that on 15.11.2017 at about 08:40 P.M. when he was returning to his village from Ara on motorcycle he saw three persons Ekram Yadv, Udhari Yadav (petitioner) and other one unidentified co-accused (driver) on motorcycle and the said motorcycle crossed and returned towards him and fired upon him by country made pistol with intention to kill him which caused injury in his chest thereafter he run away towards his village and fell near medical shop and

Patna High Court Cr.Misc. No.37594 of 2018(4) dt.11-09-2018 2/2 thereafter taken to hospital for treatment.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to land dispute between the parties. He has no criminal antecedent and is in custody since 15.05.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Arrah, Bhojpur in connection with Barhara P.S. Case No. 343 of 2017.
