2. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections Sections 341, 323, 324, 307, 498A, 504, 506 and 302 of the Indian Penal Code .

As per the prosecution case , daughter of informant, namely Sandhya Kumari, got married to one Ranjeet Kumar in May, 2023 and after eight months of marriage, Ranjeet Kumar died and at that point of time, Sandhya Kumari was pregnant for seven months. Thereafter, on 17.04.2024, she got married with co-accused Ajay Kumar. It is alleged that on 24.06.2024 at about 7 PM, while daughter of informant, namely Sandhya Kumari, was going to the house of her elder sister and

Patna High Court CR. MISC. No.1855 of 2025(3) dt.21-02-2025 2/3 reached at Dihra Bridge, all the accused persons named in the F.I.R., including this petitioner, brutally assaulted her due to which she received several injuries and during course of treatment, she died.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case merely because he happens to be father-in-law of deceased. As a matter of fact on 24.06.2024 the deceased and her husband namely Ajay Kuma were going to the house of her elder sister by motorcycle and on the way near Dihara Dam, accident took place and co-accused Ajay Kumar and his wife ( deceased ) sustained injuries and both were sent to hospital for treatment and after 7 days of the alleged occurrence deceased died. From F.I.R., it is apparent that the elder sister-in -law of the deceased had informed the informant about the aforesaid occurrence . No such occurrence as alleged in the F.I.R., has ever taken place . Informant is not an eye witness of the alleged occurrence . Informant is not eye witness to the alleged occurrence . Petitioner is in custody since 19.08.2024 . Chargesheet has already been submitted.

5 . Considering the aforesaid facts, and other circumstances of the case , prayer for bail of the petitioner is

6. Learned counsel for the State opposed the bail petition of the petitioner.

7. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI Danapur Patna in connection with Naubatpur Police Station Case No. 352 of 2024 .
