2. The petitioners apprehend their arrest in a case registered under Sections 147, 148, 149, 120-B, 341, 323, 307,

Patna High Court CR. MISC. No.210 of 2025(2) dt.04-02-2025 2/3 379, 427, 435 and 504 of the Indian Penal Code.

3. As per prosecution case, on 28.06.2024 at about 02:00 pm, 35 persons armed with iron rod, sword, pistol and explosive substance assaulted informant and snatched his purse containing Rs. 15,000/-, gold ring, PAN Card, ATM Card, Driving License and locket. It is further alleged that the accused persons set the motorcycle of informant on fire.

4. Learned counsel appearing on behalf of the petitioners submits that due to land dispute between the parties, this false and fabricated case has been lodged. Allegation of assault is general and omnibus. No specific over act has been alleged against the petitioners. It is further submitted that according to FIR, it is alleged that informant was assaulted by 35 persons, but no injury report is available on record to corroborate the same, which itself creates doubt over the veracity of prosecution case. Petitioners claim clean antecedent.

5. Learned A.P.P. appearing on behalf of the State opposed the bail application.

6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today,
