The petitioner seeks regular bail in connection with Bihta P.S. Case No. 665 of 2017 registered for offences punishable under Section 25(1-b)A/26/35 of the Indian Penal Code. Allegation against the petitioner is regarding recovery of one pistol and one cartridge.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and he is languishing in custody for more than year.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(Twenty
Patna High Court Cr.Misc. No.45553 of 2018 (3) dt.10-09-2018 2/2 Five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Danapur, District-Patna in connection with Bihta P.S. Case No. 665 of 2017, subject to condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
