2. This is an application for modification of the order dated 31.07.2024 passed in Cr. Misc. No. 34674 of 2024 filed on behalf of petitioner no. 3, namely, Saroj Kumar @ Saroj Kumar Singh.

3. Earlier the anticipatory bail of the six petitioners were allowed on 31.07.2024 in Cr. Misc. No. 34674 of 2024 with conditions.

4. The present petition has been preferred submitting that he has got a VISA for Turkiye ( earlier 'Turkey') and as such, the Court may dispense with the conditions no. 2 and 3 of the bail order.

5. Learned APP, Mr. Jitendra Kumar Singh object the prayer and submits that while condition no.2 relates to his

Patna High Court CR. MISC. No.1283 of 2025(2) dt.24-01-2025 2/2 appearance before the trial court and condition no.3 is for his appearance before the Police Station. It is his further submission that petitioner has not even given the details of whether he wants to visit the place and/or to work there and has only incorporated that he has got work Visa in Turkiye.

6. Having gone through the facts of the case and the submissions of the parties, in the opinion of the Court once an order has been passed, it is for the trial court to decide on the basis of materials that the petitioner may present before it to decide on the said conditions no. 2 and 3. This Court leaves it to the discretion of the learned trial court and it is his/her satisfaction/dissatisfaction, considering the stage of the case to decide whether the petitioner is entitled for the said relief or not.

7. The petition stands dispose of with the aforesaid observation.
