JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Excise Case No. 501 of 2018 for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody in connection with seizure of 29.64. Learned counsel submits that in the instant case there is no requirement of mandatory provision of Section 100 Cr.P.C. Learned counsel submits that petitioner is in custody since 18.05.2018.
Considering the fact that the petitioner has remained in custody for more than one and half months and he has no criminal antecedent, the petitioner, named above, is directed to
Patna High Court Cr.Misc. No.40373 of 2018(2) dt.10-07-2018 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge, Jehanabad, in connection with Excise Case No. 501 of 2018.
