2. The petitioner seeks bail in connection with Ladaniya PS Case No. 234 of 2024, dated 28-07-2024, instituted for the offence punishable under Sections 127(1), 115(2), 118(1), 109, 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. The allegation against the petitioner is to caught hold the bicycle of the informant alongwith other co-accused, thereafter, one of the co-accused, namely, Guddu Sharma assaulted on the head and hand of the informant by means of sword causing injury on his right hand.

4. Learned counsel for the petitioner submits that the

It is submitted that specific allegation of assaulted is against co-accused Guddu Shama who assaulted with sword on the head and hand of informant, due to which, he sustained injury on the right hand. It is next submitted that there is no specific allegation against the petitioner rather the allegation is general and omnibus in nature. Further submission is that the injury report of the informant shows that the injury sustained by him is grievous in nature caused by hard and blunt object which falsify the allegation of assault by means of sword. Charge sheet has been submitted in the case. Lastly, it has been submitted that the petitioner is in custody since 29-08-2024 having no criminal antecedents.

5. Learned APP for the State has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of the learned SDJM Madhubani, in connection with Ladaniya PS Case No. 234 of 2024, corresponding to G. R. No. 1690 of 2024.
