2. The petitioner is seeking bail in connection with Excise Excise P.S. Case No.684 of 2025, dated 15.10.2025 registered for the offences under Sections 30(a) & 32 of Bihar Prohibition and Excise Amendment Act, 2018.

3. As per the FIR, police intercepted a motorcycle and 14.400 liters of foreign liquor was recovered from the same.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case solely on the basis of suspicion. There has been no recovery from the petitioner or from his constructive possession, and the petitioner has no connection with the alleged recovered liquor or the motorcycle. Patna High Court CR. MISC. No.88140 of 2025(2) dt.23-12-2025 2/2 custody since 16.10.2025. Lastly, it is submitted that the petitioner has one criminal antecedent similar to the present case, in which he is on bail.

5. Learned APP for the State vehemently opposed the prayer for bail.

6. Regard being had to the submission made by the parties, and taking into consideration the period of custody of the petitioner, this Court is inclined to grant regular bail to the petitioner.

7. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions Judge-IV-cumExclusive Special Court-II, Gopalganj/ Successor Court, in connection with Gopalganj Excise P.S.
