JUSTICE ARUN KUMAR ORAL ORDER 12-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 10.4.2018, seeks bail in Hajipur Town PS Case No. 234 of 2018 registered under Sections 365, 366A, 307, 452/34 of the IPC and Section 27 of the Arms Act. The allegation in brief is that the informant' minor daughter, a student of Intermediate, was found missing, she did not return from the coaching institute on 3.4.2018, it is alleged that one Sunil Rai gave her lift on scooty and escaped away, after two days on 5.4.2018 he left her near the hospital, again on 7.4.2018 Sunil Rai came with other co-accused, forcibly kidnapped her and Sunil Rai also fired on the leg of the informant.

Learned Counsel for the petitioner submits that it is a case of elopement as the informant's daughter eloped with Sunil Rai on 3.4.2018, thereafter she was recovered from Punjab, alleged occurrence dated 7.4.2018 is fabricated and the petitioner has no concern with the incident, the girl has admitted her relationship with Sunil Rai and she used to talk to him on mobile. Having considered the said facts and circumstances, the petitioner, namely, Munchun Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Hajipur Vaishali in connection with Hajipur Town PS Case No. 234 of 2018.
