2. The present writ petition has been filed for issuance of an appropriate writ/order/direction in the nature of writ of mandamus commanding upon the concerned respondents to appoint the petitioners on Class-IV post on the basis of panel prepared for the said post by the Selection Committee constituted by District Magistrate, Bhagalpur.

3. Learned counsel for the State raised preliminary objection and submits that after the decision of the Kapil Kumar & Ors. Vs. The State of Bihar & Ors. in C.W.J.C. No. 18612 of 2019 by this Hon'ble Court, new recruitment rule of 2023

Patna High Court CWJC No.866 of 2025(3) dt.23-06-2026 3/3 namely, बबहारकारारलरपबरचारी/ पबरचारी(बवबशषट) ( भरीरएवंसेवा शर) बनरमावली2023 has come.

4. In this background, the relief as demanded by the petitioners could not be granted. However, liberty is granted to the petitioners that if they are entitled then they shall appear in the next advertisement according to the new rule.

5. Accordingly, this writ petition stands disposed off with aforesaid liberty.
