====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 09-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 308, 379, 504 and 506 of Indian Penal Code.

3. The prosecution story in brief is that on 11.05.2024, the accused persons including the petitioners armed with deadly weapons entered the house of the informant and assaulted him. It is next alleged that petitioner no. 1 assaulted the informant

Patna High Court CR. MISC. No.2650 of 2025(3) dt.09-05-2025 2/3 with iron rod and petitioner no. 2 assaulted the son of the informant. It is also alleged that petitioner no. 3 assaulted the informant's nephew and stole a box containing gold and silver worth Rs. 2 lakhs.

4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in the present case. It is next submitted that petitioners came to be implicated in this case due to dirty village politics. It is also submitted that petitioners and informant are gotiyas. It is next submitted that this is a case and counter-case between the informant and the petitioners.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the fact that petitioners and informant are gotiyas and there is a case and counter-case between the informant and the petitioners. The petitioners have also an FIR bearing P.S. Case No. 110 of 2024 in connection with Kusheshwar Asthan which has been brought on record. The dispute between the informant and the petitioners, prima facie, appears to be with regard to the land. Further, there are two criminal antecedents against the petitioners in which learned counsel for the petitioners submits that they have been

Patna High Court CR. MISC. No.2650 of 2025(3) dt.09-05-2025 3/3 acquitted. Under these circumstances, this Court is inclined to grant the privilege of anticipatory bail to the petitioners.

Accordingly, the petitioners in the event of their arrest or surrender within four weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bonds of Rs.25,000/-(Rupees Twenty-Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 109 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
