ANJANA MISHRA ORAL ORDER 02-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has been in custody since 06.11.2017 in connection with Ismailpur P.S. Case No. 58/2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. However, on perusal of the First Information Report, it appears that the present petitioner is the main assailant and the informant is the eye-witness to the occurrence and the prosecution case has further been supported by the injuries found in the postmortem report. The main role of firing has been attributed to the
Patna High Court Cr.Misc. No.44174 of 2018 (2) dt.02-08-2018 2/2 present petitioner.
As such, I am not inclined to grant regular bail to this petitioner.
It is accordingly rejected.
The court below is directed to expedite the trial so as to conclude the same within a period of nine months. (Anjana Mishra, J) Saif/- U T
