The petitioner was absent from his duties from 01.03.2015 to 07.08.2015. It is his case that he was on leave due to medical condition and has submitted application before the Executive Engineer, Minor Irrigation Division, Siwan claiming medical leave for the said period. Due to inaction of the Authorities, the claim of the petitioner has not been examined/considered. The result is that petitioner is deprived of the pay or benefits for the period in question.

Patna High Court CWJC No.829 of 2020(2) dt.14-02-2020 2/2 In view of the limited grievance, this writ petition is disposed of.

Respondent No 4 should take a final decision on the claim of the petitioner (Annexure 5) and if dues are found admissible, the same may also be paid.

The entire exercise should be completed within three months from the date of receipt/production of a copy of this order.
