The petitioner seeks bail in Bairgania P.S. Case No. 46/2018, instituted for the offences under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged in the written report that on getting information that one motorcycle rider was shot dead near Sulice Gate Ashogi Ringh Bandh, police party reached the place of occurrence and found that unknown person was lying dead and there was gunshot injury on his body. F.I.R. was lodged on the basis of self-statement of Sujit Kumar, S.H.O. of Bairgania P.S.
Patna High Court Cr.Misc. No.42932 of 2018 (3) dt.25-09-2018 2/2 Learned counsel for the petitioner has submitted that name of this petitioner has come on the basis of statement of witnesses that the petitioner was having land dispute with the deceased. Mere suspicion has been raised against this petitioner. Learned counsel for the informant has submitted that name of this petitioner has come during investigation in the statement of witnesses in case diary.
The petitioner is in custody since 20.04.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No. 46/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
