JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-02-2020 The present writ petition has been filed for quashing the order contained in Memo No. 1963 dated 14.12.2017 issued by the respondent no. 3, whereby and whereunder the license no. 01/2009 of the petitioner for public distribution system for Gram Panchayat Narawat in Atari Block in the district of Gaya, has been suspended.

The leaned counsel appearing for the respondents submits that there is a provision of appeal under Rule 32(iii) of the Bihar Targeted Public Distribution System (Control) Order, 2016, hence the petitioner can file appropriate appeal against the order dated 14.12.2017 passed by the Sub-Divisional Officer,

The learned counsel for the petitioner, in response, submits that he he granted liberty to file appropriate appeal, however, the same be directed to be disposed of within a stipulated time frame.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant liberty to the petitioner to file appropriate appeal within a period of four weeks from today and in case such an appeal is filed, the appellate authority shall decide the same within a period of twelve weeks of filing of such appeal by the petitioner herein.

The writ petition stands disposed off.
