ANJANA MISHRA ORAL ORDER 10-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 16.10.2017 in connection with Beldaur P.S. Case No. 212/2217 registered for the offences punishable under Sections 25(1-b)A/26/35 of the Arms Act.

Learned counsel for the petitioner submits that though the recoveries were made from the conscious possession and has been attributed to the present petitioner, but he has been languishing in jail for almost one year.

In view of the fact that the seizure list does not bear the signature of the present petitioner and the recoveries cannot be attributed to him as the same was not prepared in presence of

Patna High Court Cr.Misc. No.44566 of 2018 (2) dt.10-08-2018 2/2 independent witnesses.

Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria in connection with Beldaur P.S. Case No. 212/2017.
