1. Heard learned Counsel for the petitioner and learned APP for the State.

2. This application, for grant of anticipatory bail, arises out of Sastrinagar P.S. Case No. 833 of 2024, disclosing offences punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act.

3. As per the First Information Report, on 23.10.2024, the police, on a secret information intercepted one scooty and two cars. On search, police recovered 173.050 liters of illicit liquor from the said cars and scooty.

4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The petitioner has been named only on the basis that he is the registered owner of the said scooty. The scooty in question was given by the

Patna High Court CR. MISC. No.339 of 2025(2) dt.06-02-2025 2/2 petitioner to his friend for some personal work and he had no knowledge about the illicit liquor being carried in the scooty.

5. Regard being had to the submissions made on behalf of the parties and taking into consideration the justification given by the petitioner and the fact that the petitioner is having no criminal antecedent, I am inclined to grant the privilege of anticipatory bail to the petitioner.

6. This application is, accordingly, allowed.

7. Let petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Excise-II, Patna in connection with Sastrinagar P.S. Case No. 833 of 2024, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
