2. Petitioners are seeking bail in connection with Palanwa P.S. Case No. 193 of 2025 dated 15.11.2025 registered for the offences under Sections 30(a) and 41(1) of Bihar Prohibition and Excise Amendment Act.
3. As per FIR, 40 liters of country made liquor is said to have been recovered from the bike kept in plastic bag.
4. Learned counsel for the petitioners submits that the recovery is said to have been shown from the Hero Splendor Motorcycle bearing Registration No. BR-05AP-2583 and the said motorcycle does not belong to this petitioner. It is next submitted that the petitioner no.1 has one criminal antecedent,
Patna High Court CR. MISC. No.89088 of 2025(2) dt.24-12-2025 2/2 in which he is on bail. Lastly, it is submitted that both the petitioners are in judicial custody since 16.11.2025.
5. Learned APP for the State vehemently opposed the prayer for bail.

Regard being had to the submission made by the parties and taking into consideration the fact that the motorcycle, from where the recovery is said to have been made, does not belong to the petitioners and these petitioners are man of means, this Court is inclined to grant regular bail to the petitioners.
7. Let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 02, East Champaran, Motihari in connection with Palanwa P.S. Case NO. 193 of 2025.
