JUSTICE RAVI RANJAN ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 14-08-2018 Feeling aggrieved and dissatisfied with the impugned order passed by a learned Single Judge by which he has dismissed the writ petition on the ground that against the order impugned in the petition, the petitioner has already preferred an appeal before the appropriate authority, the original petitioner has preferred the present Letters Patent Appeal.

Learned counsel appearing on behalf the appellant is not disputing that against the order impugned in the petition, the appellant himself has preferred an appeal before the appropriate authority.

Patna High Court LPA No.996 of 2018 dt.14-08-2018 2/2 Under the circumstances, there cannot be any two parallel proceedings one before the appellate authority and another before this Court challenging the appellate order under which the learned Single Judge has rightly dismissed the petition.

At this stage, learned counsel appearing on behalf of the appellant has made a grievance that appeal could not be heard at the earliest.

Learned counsel appearing on behalf of respondent authorities has stated at the bar that the appeal preferred by the appellant shall be decided/disposed of within a period of six weeks from today.

The concerned respondents are directed to act accordingly. With this observation, this Letters Patent Appeal stands dismissed.
