1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Shahkund P.S. Case No. 127 of 2020 dated 19.06.2020 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016.
3. As per the first information report a total quantity of 06 liter of illicit mahua liquor wrapped in 06 plastic polythenes hanged on a motorcycle bearing registration no. BR08F0587 has been recovered and the motorcycle rider managed to flee away.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case only because he happens to be the registered owner of the motorcycle

According to the petitioner the said motorcycle was sold by the petitioner in 2018 much prior to the occurrence having no knowledge about the F.I.R. lodged against the petitioner on the basis of his being the registered owner. The petitioner has sold the motorcycle in 2018, however, the purchaser did not get the name of the petitioner removed from the registration certificate. Petitioner was not knowing about the present F.I.R., however, when Police approached him in the month of May, 2025, the petitioner took steps for anticipatory bail. The petitioner has no criminal antecedent.

Regard being had to the submission made by the parties, taking into consideration the fact that the motorcycle in question was sold as is evident from Annexure - P2 to this petition and the petitioner has no criminal antecedent, accordingly, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge XII cum Special Sessions Judge II Bhagalpur in connection with Shahkund P.S. Case No. 127 of
Patna High Court CR. MISC. No.90019 of 2025(2) dt.24-12-2025 3/3 2020 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
