2. The petitioner apprehends his arrest in connection with Complaitn Case No. 786 of 2024 registered for the offence under Sections 323, 341, 498(A), 307, 504 of the Indian Penal Code and Section 3/ 4 of the D.P. Act.
3. As per the prosecution case, petitioner is accused of assaulting and torturing his wife.
4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. Petitioner has clean antecedent.

Patna High Court CR. MISC. No.88428 of 2025(2) dt.15-01-2026 2/3 learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner on the ground that petitioner is a big businessman and has ousted the complainant due to nonfulfillment of demand of dowry.
6. In view of the law laid down in the judgment of Hon'ble Supreme Court passed Arnesh Kumar vs. State of Bihar reported in (2014) 8 SCC 273, this application for anticipatory bail is allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari/ concerned Court below in connection with Complaint Case No. 786 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.
8. As a condition of this order, the petitioner will pay maintenance of Rs. 10,000/- (Rupees Ten Thousand Only) to opposite party no.2, every month beginning from January, 2026 onwards. The amount shall be transferred in the bank account of the opposite party no.2. The account details shall be provided
Patna High Court CR. MISC. No.88428 of 2025(2) dt.15-01-2026 3/3 by the complainant in the learned court below and the amount of maintenance shall be subject to the result of the maintenance order passed by the concerned Principal Judge, Family Court.
