The petitioner seeks bail in connection with Paliganj P.S. Case No. 60 of 2025 instituted for the offence under Sections 338, 336(3), 318(4), 303(2), 317(4) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that during vehicle checking on 03.02.2025, police apprehended coaccused, namely, Pappu Kumar with a motorcycle bearing a fake registration number, which on verification was found to be stolen. Further investigation led to the arrest of other co-accused persons from whose possession another stolen motorcycle with fake number was recovered. On enquiry, all accused disclosed

Patna High Court CR. MISC. No.89957 of 2025(2) dt.16-01-2026 2/3 that the stolen motorcycles were purchased from Md. Bablu (petitioner), who allegedly used to stole and sell motorcycles. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.10.2025. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has transpired on the basis of confessional statement of coaccused. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has no concern with the recovered motorcycles. There is no compliance of Section 103 of the BNSS, 2023. Other co-accused have been granted bail by a Co-ordinate Bench of this Court, vide order dated 06.05.2025 passed in Cr. Misc. No. 27381 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, manner of petitioner's implication and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Paliganj P.S. Case No. 60 of 2025.
