JUSTICE RAJESH KUMAR VERMA ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE) 19-11-2025 The writ application has been filed seeking the following relief:
"1. That this writ application is filed for issuance of a writ in the nature of Mandamus in the nature of Public interest Litigation directing the Respondent no 2 to constitute a District label committee for inquire the illegality, irregularity in
Patna High Court CWJC No.1581 of 2025(4) dt.19-11-2025 2/3 prepare the list of Pradhanmantri Awash Yojna, Mukhya Mantri Gramin Awash Yojna at Raj Panchayat Balthar, within Jurisdiction of Block Sono Dist. Jamui (Bihar) and Misappropriate the Govt. money where several beneficiaries are not the member of Below poverty line rather they are family member of service man or owner of Vehicle or the owner of more than two Bighas land. They have taken P.M. Awash & Mukhyamantri Gramin Awash, while home less people waiting till date.
2. A counter affidavit has been filed on behalf of the State, the relevant paragraphs of which are extracted hereinbelow:
"9. That it is further submitted that the scheme and allotment (only 14 Target) had come in the year 2023-2024 only from Mukhya Mantri Yojna and after Preparation of Gram Shabha fourteen beneficiary has been selected in Balthar Panchayat and work has also been done, but after enquiry held by D.D.C. Jamui then one beneficiary became doubtful and a proceeding is going on against his namely Lalit Marandi S/o Munsi Marandi Gram Panchayat Balthar.
10. That the statement made in para-6 of writ petition is not correct, which is denied by the respondents. In this regard it is submitted that inquiry held by P.M.A.Y. observer Block Sono fountdout of six beneficiary only two person after payment of P.M.A.Y.G did not construct Awash due to some problem."
3. Considering the fact that the authorities concerned have already initiated proceedings against the persons who have illegally obtained the benefits under the Pradhanmantri Awas Yojna and the Mukhya Mantri Gramin Awas Yojna, we find no reason to pass any further order.
