The petitioner seeks regular bail in connection with Ghanshyampur P.S.case No.178 of 2017/(G.R.No.913 of 2017) registered for offences punishable under Sections 147, 148, 149, 302, 323, 341/34 of the Indian Penal Code.
Prosecution case is that niece of the informant had gone for fishing and when the accused persons came and demanded fish and on refused abused and assaulted. It is further stated that later on all the accused persons including the petitioner came and assaulted by lathi-danda and Dabia to the brother of the informant and he died on the spot.
Submission of the learned counsel for the petitioner is that there are general and omnibus allegation against the
Patna High Court CR. MISC. No.86957 of 2019(4) dt.25-02-2020 2/2 petitioner and considering the fact that all the accused persons have been granted bail by a Co-ordinate Bench of this Court vide order dated 9.7.2018 passed in Cr. Misc. No.27045 of 2018. Petitioner is in custody for more than five months. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Biraul, District Darbhanga in connection with Ghanshyampur P.S.case No.178 of 2017, G.R.No.913 of 2017.
With the above direction, this application is allowed.
