JUSTICE BIBEK CHAUDHURI ORAL ORDER 28-01-2026 The petitioner is a retired employee under the Panchayat Raj Department, Government of Bihar, whose service was controlled by respondent Nos.1, 2 & 3. The petitioner has approached this Court after his superannuation for payment of arrear salary as well as retiral dues. The date of superannuation of the petitioner is w.e.f. 31.10.2024.

2. It is submitted by the petitioner that initially the petitioner was appointed as Dalpati under the Panchayat Raj Department, Government of Bihar in the year 1994. After joining he was directed to receive training from 05.10.1994 to

Patna High Court CWJC No.891 of 2025(4) dt.28-01-2026 2/3 31.12.1994. It has already been decided by this Court in several writ petitions that a Dalpati is entitled to salary during his training period. However, the petitioner was not paid salary during the said period till date.

3. The grievance of the petitioner is also that the petitioner has not been paid his retiral dues in the form of leave encashment and provident fund dues.

4. The respondent Nos.3 to 6 have filed a counter affidavit, stating inter-alia that a sum of Rs.6,79,320/- towards the leave salary and a sum of Rs.10,00,997/- towards provisional fund dues shall be paid to the petitioner and for such payment the official process is complete.

5. In view of such admission in counter affidavit, the instant writ petition is disposed of directing the respondent Nos.3 to 6 to make the aforesaid dues towards leave encashment and provident fund to the petitioner within three weeks from the date of communication of this order.

6. The above named respondents are further directed to consider the claim of the petitioner as to whether the petitioner is entitled to arrear salary during the period between 05.10.1994 and 31.12.1994. If the respondent Authority finds that such arrear salary has not been paid, they shall take
