The petitioners seek bail in connection with Galgaliya P.S. Case No. 100 of 2025 registered for the offence under section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

As per the prosecution case, the recovery is of 112.020 liters of illicit liquor.

It has been submitted by the learned counsel for the petitioners that the petitioners are innocent and they have falsely been implicated in this case and they are in custody since 26.11.2025. He further submits that the petitioners have no

Learned counsel for the petitioners submits that the petitioners are ready to donate Rs.25,000/- collectively in some charitable organization without accepting his guilt. 6.

Considering the facts and circumstances of the case, this application is allowed.

Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise-I, Kishanganj / concerned court below, in connection with Galgaliya P.S. Case No. 100 of 2025.

This is also subject to the condition that the petitioners shall deposit an amount of Rs.25,000/- collectively in Ramakrishna Math, Bhatta Bazar, Purnea, Bihar and produce the receipt of the same before the Court below. The bail bonds of the petitioners shall be accepted after verifying the genuineness of the receipt produced by the petitioners.

9. As a condition of this order, the petitioners, after being released on bail, are directed to mark their attendance at Samastipurr Muffasil Police Station, District- Samastipur on every Sunday of the month. Any default in appearance at the

Patna High Court CR. MISC. No.88660 of 2025(2) dt.24-12-2025 3/3 police station will result in cancellation of bail bonds of the petitioners.

10. As the petitioners claim to have clean antecedent, the Court below, before accepting the bail bonds of the petitioners are directed to verify the antecedent of the petitioners. If the petitioners are found to be involved in any other case then the bail bonds of the petitioners shall not be accepted.
