Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Submission is that name of the petitioner surfaced in the confessional statement of co-accused. No incriminating material especially the prohibited liquor was recovered from possession of the petitioner. Petitioner has got no criminal antecedent.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the

Patna High Court CR. MISC. No.83239 of 2019(2) dt.07-01-2020 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Saharghat Police Station Case No.94 of 2019 corresponding to G.R.No.1535 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
