Petitioner, already in custody, seeks bail in connection with Kalyanpur P.S. Case No.216 of 2017, registered under Sections 399 and 402 of the Indian Penal Code, under Sections 25(1-b) a, 26, 35 of the Arms Act as well as under Sections 20, 22, 23, 24, 25 and 27 of the NDPS Act.

Learned counsel for the petitioner submits that nothing was seized from the possession of the petitioner, neither the narcotics nor the arms, rather recovery was made from physical possession of two persons. The narcotics was recovered from the possession of Vinay Sahni and the arms were recovered from Brijmohan Sahni and these two persons have been admitted to bail by co-ordinate Benches of this Court vide

Patna High Court Cr.Misc. No.47717 of 2018(2) dt.03-08-2018 2/2 order dated 29.06.2018 and 12.07.2018 passed in Cr. Misc. No.22900 of 2018 and Cr. Misc. No.40189 of 2018 and this petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Manoj Sahani is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Motihari, East Champaran in connection with Kalyanpur P.S. Case No.216 of 2017.
