The petitioner seeks modification of the order dated 28.02.2014 passed by a Bench of this Court in Cr. Misc. No. 48729 of 2013.

By the aforesaid order, the petitioner was granted anticipatory bail but subject to his surrender before the court below within a period of four weeks of the passing of the order.

Learned counsel for the petitioner submits that due to some unavoidable circumstance he could not surrender within the stipulated period.

For the reasons stated in the petition, the

Patna High Court CR. MISC. No.85102 of 2019(2) dt.01-07-2020 2/2 prayer is allowed.

The order dated 28.02.2014 is modified to the extent that if the petitioner surrenders before the court below within a period of six weeks from today, he shall be released on anticipatory bail on the same terms and conditions as directed earlier on 28.02.2014. The order dated 28.02.2014 stands modified to the extent indicated above.

The modification petition stands disposed of accordingly.
