12-12-2019 The petitioner seeks bail in Special Case No. 24 of 2019, arising out of Pakri Barawan P.S. Case No. 115 of 2019 registered for the offence under Sections 376/313 of the Indian Penal Code and Section 4 of the POCSO Act.

It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case and he has committed no sexual offence. It is further submitted that girl was medically examined and her age was found in between 17 to 19 years. However, in the statement of the victim girl recorded under Section 164 of the Cr.P.C. (Annexure - 2), the victim has supported the prosecution case and stated that this petitioner forcibly committed sexual offence with her.

Keeping in view the nature of allegation, I am not inclined to extend the privilege of bail to the petitioner. The prayer for bail stands rejected.
