1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Tandwa P.S. Case no. 70 of 2024 registered under sections 411 and 414 of the Indian Penal Code.

3. As per the prosecution case, a stolen motorcycle was recovered from the possession of co-accused Dhiraj Kumar who on enquiry disclosed that he had taken the said motorcycle from this petitioner.

4. Learned counsel for the petitioner submits that from the contents of the F.I.R. itself it would be evident that no incriminating article has been recovered from the petitioner's possession and the only material against him is the statement of co-accused Dhiraj Kumar made before police. Patna High Court CR. MISC. No.1738 of 2025(3) dt.11-04-2025 2/2 Kumar has been enlarged on bail vide order dated 10.12.2024 passed in Cr. Misc. no.84015 of 2024. The petitioner is in custody since 20.9.2024 and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., grant of bail to co-accused Dhiraj Kumar on whose statement before the police the name of the petitioner transpired, the petitioner having remained in custody for more than 6 months since 20.9.2024 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Tandwa P.S. Case no.70 of 2024, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Ist, Aurangabad.
