Petitioner is seeking anticipatory bail in connection with Gaurichak P.S. Case No. 239 of 2017 registered for the offences punishable under Sections 406, 420, 467, 468 and 471/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that on perusal of the written report giving rise to the present F.I.R. it would appear that the truck along with the goods have been recovered. Learned counsel further submits that the petitioner has been named in this case on a presumption that he happens to be the owner of the vehicle, but the fact is that he is uncle of the owner of the vehicle and has no concern with the vehicle in question.

Patna High Court Cr.Misc. No.50600 of 2018(4) dt.11-01-2019 2/2 Learned APP for the State is present and has opposed the prayer for bail. It is apparent from the record that owner of the vehicle is one Mantu Kumar and not this petitioner. In the given facts and circumstances, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfication of the learned Additional Chief Judicial Magistrate-VII, Patna City, District-Patna in connection with Gaurichak P.S. Case No. 239 of 2017, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
