2. The petitioner seeks bail in connection with Adhoura PS Case No. 47 of 2019 dated 10.10.2019 instituted under Sections 307 and 506/34 of the Indian Penal Code; Sections 27 and 30 of the Arms Act and Sections 30(a), 37(a), 37(b), 37(c) of the Bihar Prohibition and Excise Act, 2016.
3. The allegation against the petitioner is that he was creating nuisance after consuming liquor in a busy locality.
4. Learned counsel for the petitioner submitted that he is a guard in a local school and had gone to the place where a religious fair was being held along with his wife, when he was
Patna High Court CR. MISC. No.83550 of 2019 dt.08-01-2020 2/3 caught along with two other persons, with whom he has no connection. It was submitted that the petitioner has no criminal antecedent and is in custody since 11.10.2019.
5. Learned APP submitted that the petitioner has consumed liquor and was creating nuisance in a public place.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 25,000/- (Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-3rd-cum-Special Judge Excise, Kaimur (Bhabhua) in Adhoura PS Case No. 47 of 2019.
7. One of the bailors shall be a close relative of the petitioner. The petitioner and the bailors shall execute bond with regard to good behaviour of the petitioner. The petitioner shall also give an undertaking to the Court that he shall not indulge in any criminal activity. Any violation of the terms and conditions of the bonds or the undertaking shall lead to cancellation of his bail bonds. The petitioner shall cooperate in the case and be present before the Court on each and every date. Failure to cooperate or appear on two consecutive dates, without sufficient cause, shall also lead to cancellation of his bail bonds.
