JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-12-2019 The petitioner seeks regular bail in connection with Sarai P.S. Case No. 357/2019, registered for offences punishable under Sections 414/34 of the Indian Penal Code and Sections 30(a), 32(2), 35(a), 38(i) and 41(i) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of more than 1100 litres of liquor from the truck and other vehicles and petitioner was arrested on spot.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and he was only loading the the wine from truck to other vehicles. Further submission is that he has no criminal antecedent and has been in judicial custody since 16.10.2019 and chargesheet has been submitted. Heard learned A.P.P. also.

Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum Excise Court, Vaishali at Hajipur, in connection with Sarai P.S.
