JUSTICE BIRENDRA KUMAR ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467,468,471,120B of the Indian Penal Code and Section 13(2), 13(i)(d) of Prevention and Corruption Act, 1988.

Allegation against the petitioner and others is that they were appointed as Gramin Dak Sewak on the basis of fake credential produced by them.

Submission of learned counsel for the petitioner is that Dr. Anil Kumar Ishwar, against whom allegation was of issuance of fake certificate, has already been

Patna High Court Cr.Misc. No.48244 of 2018 (3) dt.08-10-2018 2/2 allowed regular bail in Cr. Misc. No.38864 of 2017. The petitioner has no knowledge about the genuineness of the certificates rather the petitioner is still of the view that the same is a genuine document. Petitioner has already left the said job. Petitioner is ready to refund the salary amount, if received by him during his employment. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with C.B.I. Case No.

RC 24 (A)/2014 Special Case No.09 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
