The petitioner, already in custody, seek bail in connection with Buxar (Mah.) P.S. Case No.-36 of 2018, registered under Sections 366(A), 376, 313, 420, 120(B) of the I.P.C and Section 4 of the POCSO Act.

The accusation is that one year prior the petitioner enticed away the prosecutrix and established sexual relationship for one year but refused to marry. Thereafter, the present case was instituted.

The contention of the learned counsel for the petitioner is that the girl is major and the story of elopement is absurd as no case was instituted for one year. The statement of the victim itself reflected that she wanted to marry the

Patna High Court Cr.Misc. No.48706 of 2018(2) dt.09-08-2018 2/2 petitioner. So, to put pressure, the present case has been instituted against the petitioner. The petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely Ram Bilas Ram, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1 Cum Special Judge SC/ST and POCSO Act, in connection with Buxar (Mah.) P.S. Case No.-36 of 2018.
