The petitioner, who is in custody, seeks bail in connection with Khusrupur P.S. Case No. 139 of 2017 registered for the offences punishable under Sections 399, 402, 353, 307 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act and Sections 20 and 22 of the N.D.P.S. Act.
Informant is the police officer, who has stated that he received secret information that some miscreants have assembled on highway to commit crime and on that information he along with other police personnel raided the place and arrested petitioner with loaded revolver and two live cartridges and other 16 accused.
Patna High Court Cr.Misc. No.50864 of 2018(3) dt.28-09-2018 2/2 It has been submitted on behalf of the petitioner that petitioner is innocent and has committed no offence. Nothing has been recovered from the possession of petitioner. It has been further submitted that similarly placed co-accused persons, namely, Kunal Singh, Akram Mahir and Md. Faizuddin Alam have been granted bail by a co-ordinate Bench of this Court passed in Cr. Misc. No. 53026 of 2017 and 11738 of 2018 vide order dated 10.01.2018 and 08.03.2018 respectively. Petitioner is in custody since 19.07.2017 Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge X, Patna, in connection with Special P.S. Case No. 101 of 2017 (arising out of Khusrpur P.S. Case No. 139 of 2017).
