JUSTICE P. B. BAJANTHRI) 25-04-2025 Re:I.A. No. 02 of 2019 Heard I.A. No. 02 of 2019, there is a delay of about 423 days in filing LPA. For the reasons stated in application read with the affidavit, delay of about 423 days in filing LPA stands condoned. Accordingly, I.A. No. 02 of 2019 stands allowed.

2. On 12.08.2024, we have passed the following the

Patna High Court L.P.A No.1627 of 2019(6) dt.25-04-2025 2/3 order:- "Re: I.A. No. 02 of 2019 Heard I.A. No. 02 of 2019.

2. There is a delay of about 423 days. Sufficient cause has not been shown.

In paragraph Nos. 6 and 7, it is stated as under:

"6. That it is humbly stated that in a similar matter, the State of Bihar preferred an Intra Court Appeal against the order under contempt vide L.P.A. No.

1312 of 2018 (The State of Bihar & Ors. Vs. Janardan Prasad Singh) before this Hon'ble Court, which has been dismissed vide order dated 27.02.2019.)

7. That it is humbly stated that the State Government has preferred a SLP against the order dated 27.02.2019 passed in LPA No. 1312 of 2018 The State of Bihar & Ors. Vs.

Janardan Prasad Singh) before Hon'ble Supreme Court of India bearing SLP(C) No. 12333 2019. in which the Hon'ble Supreme Court has stayed the operation of the said order dated 27.02.2019 vide order dated 02.07.2019."

3. List this matter after disposal of SLP (C) No. 12333 of 2019 in view of the fact that order passed in LPA No. 1312 of 2018 dated 27.02.2019 stands stayed on 02.07.2019."

3. Today learned counsel for the State Mr. Ram Vinay Prasad Singh furnished copy of the Hon'ble Supreme Court decision dated 29.08.2023 in which State has suffered an order in the case of State of Bihar & Ors. vs. Janardan Prasad Singh & Ors. Resultantly, the present LPA No. 1627 of 2019 stands

Patna High Court L.P.A No.1627 of 2019(6) dt.25-04-2025 3/3 dismissed.
