This petition has been filed for modification of the order dated 04.09.2017 passed in C.W.J.C. No.19586 of 2016, by which this Court had appointed Mr. Justice V. Nath (Retired) as an Arbitrator to resolve the dispute, but it has been informed

Patna High Court MJC No.2973 of 2018(3) dt.19-09-2018 2/2 that he has shown his inability to continue as an Arbitrator to resolve the dispute.

In such view of the matter, Mr. Justice Samrendra Pratap Singh (Retired) is appointed an an Arbitrator in place of Mr. Justice V. Nath (Retired) to resolve the dispute. The pleadings before Mr. Justice V. Nath (Retired) will be treated to be the pleadings before Mr. Justice Samrendra Pratap Singh (Retired) and this Court requests Mr. Justice Samrendra Pratap Singh (Retired) to complete the proceeding within statutory period starting from the date of initiation of first day of proceeding.

Accordingly, the order dated 04.09.2017 is modified to the above extent, accordingly, the modification petition is disposed of.
