This application is for grant of regular bail in connection with Beur P.S.Case No.315 of 2019 dated 24.8.2019 for the offences under Sections 302,120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR, it appears that there are some dispute between one Niraj Singh and the deceased and it appears that the accused persons including the petitioner have killed the deceased.

Submission of the learned counsel for the petitioner is that whatever dispute was there that is between Niraj Singh and the deceased and the petitioner has falsely been implicated in this case on the basis of confessional statement

Patna High Court CR. MISC. No.84360 of 2019(3) dt.19-02-2020 2/2 recorded by the police that is not admissible as the evidence. Petitioner is in custody since 25.8.2019.

Heard learned A.P.P. , who has opposed the prayer for bail drawing may attention towards the evidence of some of the witnesses, who have disclosed that while the deceased was going out they told that the petitioner is calling him and thereafter he was killed.

Having heard both sides and considering the above facts, I am not inclined to grant bail to the petitioner at this stage.

With the aforesaid observation, this application is dismissed.
