Petitioner is an accused in connection with Kowakole P.S. Case No. 103 of 2018 for the offence registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case. It is further submitted that nothing incriminating has been recovered from the conscious possession of the petitioner and he is in custody since 28.08.2019. As a matter of fact, the deceased was a notorious criminal and his counterpart has killed him. This petitioner is nowhere involved in the alleged occurrence. Learned A.P.P. for the State has opposed that prayer
Patna High Court CR. MISC. No.83053 of 2019(5) dt.01-06-2020 2/2 for bail and submitted that petitioner happens to be member of the group of criminals and he along with other killed the head of the group. Moreover, the petitioner is having serious criminal antecedents which is evident from paragraph-3. Having considered the above facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of this petitioner is rejected.
